Commissioners review facility use policy and wastewater regulations

Gilpin County Board of Commissioners regular meeting was held 9:00 am on Tuesday on June 26, 2018 chaired by Commissioner Ron Engels, along with Commissioners Linda Isenhart and Gail Watson. Also present were, County Attorney Jim Petrock, and Deputy Clerk to the Board Sharon Cate.The County manager position remains vacant.
Gilpin County Chief Deputy Treasurer Mary Lorenz presented the end of month Treasurer’s report for the month May 2018. Property tax numbers are up slightly with the grand total reaching to over $14.8 million dollars, which is $1.2 million dollars over last year’s total.
Cemetery Fence Repairs Agreement
Gilpin County Public Works Director Gordon Thompson presented A Memorandum of Understanding (MOU) for the cemetery fence project that Gilpin County participated in funding. The previous MOU only holds Gilpin County responsible for repairing damage caused by Gilpin County. The new MOU holds both the City or County responsible for damage to the fences or any portion thereof, the party responsible for the damage shall be solely responsible for repairing the damage, including all costs and expenses of effecting the necessary repairs and/or replacement. Gilpin County unanimously approved the MOU as presented.
Road Maintenance Agreement with Central City
Gilpin County Public Works Director Gordon Thompson also presented an Intergovernmental Agreement (IGA) to the Commissioners between Gilpin County and Central City. Gilpin County and Central City each own portions of Upper Apex and Bald Mountain Roads and the County agreed in a May 2003 IGA to maintain 2.6 miles that belongs to Central City for compensation. Over the years the compensation has changed. This IGA will adjust the compensation back to the level of the original 2003 IGA already in place and make the additions that have occurred over the years. This new IGA defines compensation as: Central shall provide the County with secure equipment parking on Central City’s property at Boodle Mill, equipment parking at the salt sand shed on Central City Parkway, treated water as needed for use at the County wash bay, use of the lower entrance at Chase Gulch Reservoir to pump water for road maintenance, use of Central’s man lift, and assistance with drifting snow on Central’s portion of Upper Apex and Bald Mountain Roads. This IGA was postponed for vote due to some outdated language and old references
Election Agreement with Black Hawk
Gilpin County Clerk & Recorder Coleen Stewart presented Resolution 18-06 which is a resolution to approve an Intergovernmental Agreement (IGA) Between Gilpin County and the City of Black Hawk. In the upcoming IGA, the Gilpin County Clerk & Recorder will assist Black Hawk with the upcoming election November 6, 2018. The County Clerk and the district agree to the scheduling of a coordinated election and the County Clerk shall serve as the Coordinated Election Official for the political subdivisions involved in this election. The County Clerk will perform all duties, provide all services and supplies, and render all decisions per Title 1 of Colorado Revised Statutes. In return Black Hawk will reimburse the County Clerk for their portion of the actual costs of services and supplies, even if the election is cancelled. Gilpin County Commissioners approved the resolution to approve the IGA. As a side note, Ms. Stewart reported that 1,093 voters turned in their ballots as of June 25th, with over two thousand ballots left uncast. Hopefully those last minute voters will cast those remaining votes.
County Facilities Use Policy
Gilpin County Facilities Use Coordinator Vicki Nemec and Parks & Recreation Director Kyle Benedict presented an updated Facilities Use Policy to the Gilpin County Commissioners. The updated policy involves several changes including removal of the Justice Center as a meeting option which will directly affect The Light on the Hill Church. Damage deposits will be calculated on a “per day” rather than the existing “per event” schedule. Costs of the various rooms in the Community Center will increase. For example the Multi-purpose room will jump from $50 per event to $70 per hour for a resident events and $90 per hour for a non-residential event. The indoor arena will not increase for resident events ($75 per day) but nonresident events will jump from $75 per day to $100 per day. Also added to the new policy, are Weber and Elk Ballfields at $75 per day. After much debate the Gilpin County Commissioners agreed to postpone the vote on the new policy to add some additional fees and add clarification of some of the verbiage.
Wastewater Treatment Systems
Chair Ron Engels closed the Commissioners Regular meeting and reconvened as the Board of Public Health at 10:04 am. Community Development Director Stephen Strohminger presented a revised version of the Gilpin County Onsite Wastewater Treatment System Regulations for new construction. Commissioner Watson pointed out that in the 2014 revision, there was a regulation that requires parcels under two acres to incorporate an advance wastewater treatment system. This regulation is missing in the new revision. Mr. Strohminger replied that this revision is a State regulation. Commissioner Watson said she expected to see a redlined revision showing the changes. The document that was presented didn’t point out what the changes were or where they were incorporated, nor does it address the local county requirements that are more stringent than the State document. Chair Ron Engels pointed out that there is a potential that some local requirements have been left out of this new version, and if the revision were to be approved at this meeting, there will be additional Public Hearings in the future to approve the amendments. The Commissioners agreed to postpone the document approval until a later date so that the Planning Department has time to present an easily understandable and complete document. The new date set for the next Public Hearing will be July 10, 2018 at 9:00 am. The Board of Health was adjourned at 10:13 am, and the Commissioners Regular meeting re-convened.
Legal Status Report
Gilpin County Attorney Jim Petrock announced that he really didn’t have anything except he is proposing an Executive Session per Colorado Revised Statutes to receive legal advice on personnel matters that may lead to possible litigation. Commissioner Engels asked Mr. Petrock about an updates to the barking dog/working dog issue. Mr. Petrock responded that they are looking into a more restrictive definition of a “working dog” that will address the recent issues the County has had.
Colorado Counties Inc. (CCI) is soliciting for legislative issues for the upcoming 2019 Colorado legislative session. The deadline to submit the application form is June 29, 2018. Commissioner Engels suggested that with the recent decision by the Supreme Court ruling making sports betting a state’s rights issue, it would benefit Gilpin County to work closely with CCI to be able to get something referred that would be in Gilpin County’s best interest. Colorado State Representative for District 13, K.C. Becker told Commissioner Engels that they were confident that the Colorado Legislature would not take any direct action for or against sports gambling, but instead refer the issue to the voters of Colorado.
Commissioner Watson suggested that CCI push for increased state funding for County Courthouses because this is a responsibility that the State can push onto the Counties and increase the State’s responsibility for housing felons. The state enacted legislation in 2017 to send Multiple DUI felons to the various county jails, but did not enact any legislation to fund this increase of inmates. There are multiple DUI felons currently housed at the Gilpin County Jail. Gilpin County Sherriff Bruce weighed in and stated that he doesn’t know how the numbers directly affects Gilpin County, but this is a trend that Colorado Department of Correction (DOC) is using to reduce its inmate load by sending them to County jails without addressing the funding issues.
County Employee Picnic
The Commissioners agreed to have an employee summer picnic for the Gilpin County employees. The event will take place at the Community Center Multi-purpose Room on Tuesday, July 31, from 11:00 am to 1:00 pm.
The Gilpin County Commissioners approved the meeting minutes from the Regular Board of County Commissioners dated June 12, 2018 with no corrections.
The next Commissioners meeting will be July 10, at 9:00 am at the historic Gilpin County Courthouse, 203 Eureka St, Central City Colorado.
